1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you ("Customer," "you," or "your") and MultihopIX ("we," "us," or "our") governing your access to and use of our internet services.

2. Service Description

MultihopIX provides residential and commercial internet connectivity services using BGP multi-hop architecture. Service availability, speed, and reliability may vary based on location, network conditions, and service plan selected.

3. Account Registration and Security

You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account
  • Not share your account with unauthorized users
  • Configure BGP sessions securely following our security guidelines

4. Payment Terms

Customers agree to pay all fees associated with their selected service plan. Payment is due according to your billing cycle (monthly, quarterly, or annually). Late payments may result in service suspension or termination. Early termination fees may apply as specified in your service agreement.

5. Service Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible. We are not liable for service interruptions due to circumstances beyond our control, including natural disasters, power outages, or third-party infrastructure failures.

6. Fair Use Policy

Unlimited plans are subject to fair use policies. Excessive bandwidth usage that negatively impacts network performance for other users may result in speed throttling or plan modification. We will provide notice before taking such action. Typical residential usage is not subject to limitations.

7. Equipment

Any equipment provided by MultihopIX remains our property and must be returned upon service termination. You are responsible for any damage to or loss of provided equipment. You may use your own compatible equipment subject to our technical specifications and security requirements.

8. Acceptable Use

Your use of MultihopIX services is subject to our Acceptable Use Policy. Prohibited activities include but are not limited to spam, network attacks, malware distribution, illegal content, and BGP routing abuse. Violations may result in immediate service termination.

9. BGP Peering Requirements

For customers using BGP services:

  • You must maintain valid RPKI ROA records for announced prefixes
  • BGP sessions must use MD5 or TCP-AO authentication
  • You may only announce prefixes you are authorized to announce
  • Route filtering and security measures must be implemented per our guidelines
  • You are responsible for proper routing policy configuration
  • AS path manipulation and route hijacking are strictly prohibited

10. Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our services with reasonable notice. Price changes will be communicated at least 30 days in advance for existing customers. Network topology and routing changes may occur with limited notice for operational reasons.

11. Privacy and Data

Your use of our services is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information and usage data.

12. Limitation of Liability

MultihopIX shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use our services. This includes but is not limited to data loss, business interruption, routing errors, or BGP misconfigurations. Our total liability shall not exceed the amount paid by you for services in the three months preceding the claim.

13. Indemnification

You agree to indemnify and hold MultihopIX harmless from any claims, losses, or damages arising from:

  • Your violation of these Terms or the Acceptable Use Policy
  • Your violation of any third-party rights, including intellectual property rights
  • Misconfigurations or security vulnerabilities in your equipment
  • BGP routing errors or unauthorized prefix announcements
  • Any illegal activity conducted using your service

14. Network Security

You are responsible for:

  • Securing your network equipment and BGP sessions
  • Implementing appropriate firewall and access controls
  • Keeping software and firmware updated
  • Monitoring for unauthorized access or compromise
  • Responding to security incidents and abuse reports

15. Termination

Either party may terminate service with 30 days' notice. We may terminate immediately for:

  • Violation of these Terms or the Acceptable Use Policy
  • Non-payment or fraudulent payment information
  • Illegal activity or abuse of network resources
  • BGP routing violations or security breaches
  • Failure to respond to abuse complaints

Upon termination, you must return all equipment and pay any outstanding balances. IP address allocations and AS number assignments are revoked immediately.

16. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive the right to participate in class action lawsuits. Before filing arbitration, parties agree to attempt resolution through good-faith negotiation.

17. Governing Law

These Terms shall be governed by the laws of the state in which MultihopIX is incorporated, without regard to conflict of law provisions.

18. Intellectual Property

The MultihopIX name, logo, website content, and documentation are protected by intellectual property laws. You may not use our trademarks or copyrighted materials without written permission.

19. Force Majeure

Neither party shall be liable for failure to perform due to causes beyond reasonable control, including natural disasters, war, civil unrest, internet infrastructure failures, or government actions.

20. Entire Agreement

These Terms, together with the Acceptable Use Policy and Privacy Policy, constitute the entire agreement between you and MultihopIX regarding our services.

21. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

22. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of our services after changes are posted constitutes acceptance of the modified Terms.
